Red Flags When Buying a Flat: 12 Warning Signs to Watch
Quick answer
The biggest red flags when buying a flat are a project missing from the RERA portal, demands for more than 10% before a registered agreement, cash or personal-account payments, vague cost sheets, pressure to book on the spot, unclear land title, missing approvals and a builder with no delivered projects. Each has a simple check you can do before paying.

Why spotting red flags when buying a flat matters
A home is usually the biggest purchase a family makes, and most problems are visible early if you know where to look. The red flags when buying a flat fall into four groups: the project, the paperwork, the payments and the sales process. Use this list as a filter before you pay a token. None of these signs proves wrongdoing on its own, but each deserves a clear written answer.
Project red flags
- Not on the RERA portal, or the registration number does not match the brochure. Check the UP RERA portal and read how to verify a UP RERA project.
- No delivered projects by the same company, or delivered projects you are not allowed to visit.
- Progress on the RERA page lags far behind demands you are being asked to pay.
Project-level checks take an afternoon. Search the portal, note the registration number and the promised completion date, and look at the quarterly progress the promoter has uploaded. Then drive to a delivered project by the same company and speak to two or three residents about construction quality and after-sales service.
Paperwork red flags
- Unclear land title or refusal to show approved plans.
- Only super area quoted; no carpet area in writing. See carpet area vs super area.
- An agreement full of one-sided clauses — big penalties for you, none for the builder. Read agreement for sale clauses.
- Possession offered without occupancy approval — see occupancy vs completion certificate.
Paperwork problems are the hardest to fix after you pay, so ask for copies early. A lawyer's review of the title, approvals and draft agreement usually costs far less than the booking amount — and can save it.
Payment red flags
- More than 10% demanded before a registered agreement for sale — the RERA Act does not allow it.
- Cash, or payment to an individual's account rather than the company.
- A cost sheet with blanks — "other charges as applicable" without amounts. Learn how to read builder cost sheet items.
Every payment should leave a trail: a demand letter, a bank transfer in the company's name and a stamped receipt. If you take a home loan, your bank will insist on this trail too, and it protects you if there is ever a dispute or a refund to claim.
Sales-process red flags
- "Only today" pressure to book immediately at a special price.
- Guaranteed returns or rental promises — no one can guarantee appreciation, and such promises are a warning sign.
A good builder gives you time, answers in writing and lets you take documents home to show a lawyer or family member.
Quick checklist table
| Check | How |
|---|---|
| RERA registration | Search the project on the UP RERA portal |
| Builder record | Visit a delivered project; talk to residents |
| Company details | Look up the company's CIN on the government company registry |
| Cost sheet | Every charge listed with amounts; GST shown separately |
| Payments | Only to the company's account; receipt for every rupee |
| Agreement | Read fully; ask a lawyer to review |
Green flags to look for instead
- RERA details printed clearly on all material.
- A registered company with a public record and an office you can visit.
- Delivered projects nearby that you can walk through.
- Written cost sheets with all components and a clear payment plan.
- Direct sales with no pressure to decide on the spot. See why buy directly from the builder.
